FCT Bye-Law: Court Bars AMAC from Arresting Private Vehicles Not Used for Commercial Purposes

A High Court of the Federal Capital Territory (FCT) has barred the Abuja Municipal Area Council (AMAC) from arresting or impounding privately owned vehicles that are not used for commercial purposes.
The court held that AMAC and its agents lack the legal authority to seize private vehicles operating strictly for personal use under its bye-laws.
The ruling followed a suit filed by an Abuja resident who challenged the seizure of his private vehicle by AMAC officials.
The claimant argued that the council unlawfully impounded his car and demanded payment under a bye-law that does not apply to non-commercial vehicles.
Delivering judgment, the court restrained AMAC, its officers, and agents from further arrest, detention, or confiscation of private vehicles not engaged in commercial activities.
The court also awarded damages against the council and ordered a refund of illegally collected fees.
The decision is expected to have significant implications for vehicle owners within the FCT, particularly residents who use their vehicles strictly for personal transportation.
