Court Verdict on ADC Leadership Victory for Rule of Law, Says Atiku
By Peace Erewunmi
Former Vice President and presidential candidate of the African Democratic Congress (ADC), Atiku Abubakar, has welcomed the Federal High Court judgment affirming the leadership of the party under former Senate President David Mark, describing the decision as a victory for constitutional democracy, the rule of law, and judicial independence.
The judgment followed a suit filed by a member of the House of Representatives, Leke Abejide, challenging the emergence of David Mark as the National Chairman of the ADC and Ogbeni Rauf Aregbesola as the party’s National Secretary. The court dismissed the suit for lacking merit and held that issues relating to the internal leadership of a political party are generally not justiciable in the circumstances presented.
Reacting to the ruling, Atiku said the decision reaffirmed the independence of the judiciary and demonstrated that the courts cannot be used as instruments for political manipulation. According to him, the judgment strengthens public confidence in Nigeria’s democratic institutions and reinforces the constitutional order.
Atiku commended the judiciary for what he described as its courage and fidelity to the Constitution despite what he alleged were attempts by political interests to influence the legal process. He maintained that the ruling sends a strong message that democratic processes and the rule of law remain the foundation of Nigeria’s political system.
David Mark also welcomed the court’s decision, describing it as a victory not only for the African Democratic Congress but for democracy itself. He said the judgment validates the leadership structure adopted by the party and provides a solid foundation for its future political activities.
The Federal High Court held that the emergence of the David Mark-led leadership complied with the party’s constitution and relevant provisions of the Electoral Act, 2026. The court further awarded costs against the plaintiff and imposed sanctions on counsel in line with the provisions of the Electoral Act relating to frivolous litigation.
The ruling is expected to strengthen the position of the Mark-led National Working Committee as the party continues preparations ahead of the 2027 general elections. Political observers believe the judgment removes a significant legal obstacle to the ADC’s internal reorganisation and coalition-building efforts.
Atiku reaffirmed his commitment to working with other party leaders to build a strong opposition platform, expressing confidence that the party would continue to pursue its political objectives through lawful and democratic means. He urged members to remain united and focused as preparations for future elections continue.
