Confusion Trails Trial of Suspected Coup Plotters

Uncertainty has reportedly emerged over the trial process for military officers accused of plotting to overthrow the administration of President Bola Tinubu, as authorities deliberate on the appropriate legal framework to prosecute the suspects.

Reports indicate that there is ongoing debate within the Federal Government and the military hierarchy over whether the accused officers should face a court-martial or be tried in a civilian court, such as the Federal High Court.

The development follows earlier confirmation by the Defence Headquarters that some serving officers were arrested over an alleged coup plot. The military had stated that investigations were underway and that those implicated would be brought before a military panel.

Legal Debate Over Jurisdiction

However, legal experts have raised concerns about jurisdiction, noting that while members of the armed forces are subject to military law, coup-related offences may also fall under provisions of Nigeria’s Constitution and criminal statutes, which could require trial in a civilian court.
